General Travel Terms of travelling with Desert Dream Tours
These general terms of business regulate the legal relations between the tour operator Desert Dream Tours in Wadi Musa, Jordan, and you as a customer.
1. Services
The extent of the contractual service arises from the service description as well as from the statements relating to it in the individual travel confirmation sent to the customer.
Possible changes need the written approval by Desert Dream Tours. Evident mistakes and omissions are not binding for Desert Dream Tours.
Desert Dream Tours bears no responsibility for photos, literature and other informative publications which lie in the responsibility of third parties.
2. Completion of the Travel Contract
With the registration the customer obligingly offers Desert Dream Tours the completion of a travel contract.
The travel contract originates from the offer of Desert Dream Tours and the acceptance by the customer, is not binding and can be cancelled if necessary.
An abolition must happen as fast as possible, however, within 3 days after completion of the contract with the customer.
By completion of the contract the customer has to make available all necessary information about himself and other participants that are necessary for the correct realisation of the agreed services.
The customer is responsible for all obligations originating from the contract compared with himself and the other participants.
3. Payment Information
The price is based on the program proposal in the agreed offer and is valid in US$ per person unless it is explicitly agreed different.
The price is based on the exchange rates, prices and taxes as they were known to Desert Dream Tours at the time of publication of the offer.
Should a price increase be necessary about more than 10% to cover the necessary costs, the customer is immediately informed about it and he can withdraw from the travel contract free of charge. Price increases after the 20th day before the agreed travel appointment are ineffective.
Deposit
Upon receipt of the travel confirmation 30% of the total travel cost are due to be down paid within 10 days.
Due to the coronacrisis we have decided to temporarily not ask for a down payment. The following terms will apply from today 30 September 2020 until further notice:
– As soon as your reservations are confirmed we will send you an official confirmation via email.
– The complete payment needs to be made (100%) maximum 14 days before arrival of the passenger.
– Last minute bookings (less than 2 weeks before arrival), need to pay the 100% payment directly.
– You are able to pay via bank transfer.
– In case of no payment before the given date by the agency, all reservations will be cancelled.
Final Payment
The final payment is due 1 month before travel start provided the trip is confirmed to be carried out and cannot be called off any more for reason as in point 9 and must be incurred unasked at Desert Dream Tours.
In case of delayed payment Desert Dream Tours can withdraw from the contract after request for payment. In this case produced payments are not paid back before and find the conditions of point 5 of this contract.
4. Changes by the Customer
Desired changes of the customer in parts of the tour will be considered by Desert Dream Tours as much as possible. Resulting extra costs will be charged to the customer.
5. Cancellation
In case of cancellation by the customer the following conditions will apply if not agreed upon differently in writing:
Should the customer discontinue the contract, the following amounts will be due in Desert Dream Tours:
- In case of cancellation up to 30 days before arrival: 50 JD per person administration costs.
- In case of cancellation from 30 up to 20 days before arrival: 30% of the total sum
- In case of cancellation from 19 up to 15 days before arrival: 50% of the total sum
- In case of cancellation from 14 days before arrival including the day of arrival or no show: 100% of the total sum
Due to the coronacrisis we have amended our cancellation terms, to be more flexible for everyone.
– If the cancellation is more than 15 days before arrival, no costs will be charged.
– If the cancellation is between 14 and 8 days before arrival, 50% of the payment will be charged.
– If the cancellation is from 7 days before arrival including the day of arrival or no show: 100% of the total sum will be charged.
Up to the travel start the customer can request that instead of him a third person takes part in the trip. Desert Dream Tours can contradict the participation of the third person if this person does not suffice the special travel requirements, or his participation contradicts legal regulations or official orders. The third person entering the contract and the original traveller are held responsible towards Desert Dream Tours for all extra costs deriving from the entry of the third person.
6. Not taken up Services
If the customer does not take up single travel services that Desert Dream Tours has offered properly, as a result of untimely return journey, due to illness or other reasons which Desert Dream Tours cannot be held responsible for, the customer is not entitled to claim any refunds of the travel price of these not taken up services.
7. Insurance
The customer himself is responsible for travel insurances.
8. Documents / Visas / Vaccinations
By completion of the contract at the latest Desert Dream Tours will inform the customer concerning passport and visas.
The customer himself must take care that his passport shows a sufficient validity for the trip, minimum 6 months.
Should the customer not be able to undertake or to finish the tour due to missing necessary documents, he will be charged with deriving costs.
The customer should collect necessary additional information at authorities concerned as well as make sure that this information has not changed until departure.
9. Cancelling and Changes due to Important Circumstances on Part of Desert Dream Tours
Should the tour not be undertaken due to important circumstances, that Desert Dream Tours has no influence on, Desert Dream Tours is obliged to inform the customer immediately. After this announcement the contract is considered as cancelled. All money which has already been paid by the customer is to be refunded immediately.
Should the tour be changed due to important circumstances, that Desert Dream Tours has no influence on, Desert Dream Tours is obliged to inform the customer immediately with simultaneous announcement of possible extra costs.
Desert Dream Tours is authorised to withdraw customers, of whom the realisation of the tour cannot be expected, from the contract on receipt of this announcement.
10. Liability of the Tour Operator
Should the tour not be carried out according to plan, Desert Dream Tours is responsible towards the customer for all damages originating from it, unless the inadequacy cannot be ascribed to Desert Dream Tours, because the inadequacy for the realisation of the contract is on part of the customer; or the inadequacy for the realisation of the contract cannot be ascribed to Desert Dream Tours on account of higher power, as described in point 11.
11. Force Majeure
If by completion of the contract the trip as a result of non predictable higher power is considerably complicated, endangered or affected, Desert Dream Tours as well as the customer can discontinue the contract. Force majeure is understood as unpredictable circumstances which are beyond will and control of whom they refer to as well as consequences which cannot be avoided in spite of all precautions. In this case Desert Dream Tours can withhold the deposit of 30% of the travel price as an adequate compensation.
Hotel changes because of overbooking or local conditions will be made to a suitable hotel of the same or superior classification.
12. Limitation of the Liability
Desert Dream Tours assumes no liability for damages which are covered by the usual medical, accident, travel and/or resignation insurance policies.
Your rooming preferences as indicated on your reservation form (twin, double, single, smoking/non-smoking, etc) will be conveyed to each hotel at the time your room is booked. Desert Dream Tours is not responsible for hotel room assignments. We make every effort to help the hotels accommodate your requests, but they are not guaranteed.
Generally speaking, check-in time is 15.00 hours and check-out time is 12.00 hours. If you are planning to arrive and/or depart on a middle-of-the-night flight and would like to have a room available, we suggest that you inquire about booking an extra night’s stay.
13. Obligations of the Participant
The customer is obliged to follow all instructions of Desert Dream Tours which are in the interest of a satisfactory implementation of the tour and is responsible for all damages which originate from his incorrect behavior.
If the customer in spite of a corresponding warning by Desert Dream Tours disturbs with lasting effect or behaves contrary to the terms of the agreement in such extent that a continuation of the contractual relationship is unreasonable up to the agreed termination, Desert Dream Tours can discontinue the travel contract without notice. Moreover, the tour operator reserves the right to claim the travel price less saved expenditures. Possible additional costs for a return transportation are born by the disturber himself.
A participant who hinders the satisfactory implementation of the tour by disturbance or nuisance or threatens to hinder can be excluded from (further) participation in the tour, if this person is believed not to be capable to observe the contract. All costs originating from it will be charged to the customer.
14. Procedure in Case of Discomfort
The tour operator must be notified about each ascertained inadequacy in the implementation of the contract as fast as possible, so that he can find a suitable solution. The customer has to claim rights due to an execution not according to the contract of the trip within 14 days after termination of the trip’s contractual planned ending at Desert Dream Tours.
